Nordic penal exceptionalism: A comparative, empirical analysis

Abstract Based on a survey administered in 13 prisons in England & Wales and Norway, as part of a research programme with explicitly comparative aims, this article seeks to address both the relative and absolute dimensions of the Nordic penal exceptionalism thesis. It outlines the consistently more positive results in Norway compared to England & Wales, explaining them primarily with reference to the former’s much higher quality and use of open prisons. In January 2020, two persons in Norway were condemned by a unanimous Supreme Court of Norway for comments posted on ‘closed’ Facebook groups. With the two decisions, the Supreme Court confirmed for the first time the boundaries of hateful, racist, and discriminatory speech in the context of online utterances in social media. Abstract: Comparative penologists have described neoliberal and social democratic jurisdictions as though they exist at opposite ends of a continuum of inclusion and exclusion, and as though neoliberal states are inactive and social democratic states are invasive. The objective of this paper is to investigate the impact of economic freedom on brain drain from developing countries to rich countries. Previous literature on brain drain has examined social, political and economic determinants. However, no study in the literature so far has studied this proposed relationship. We employ the Economic Freedom Index sourced from the Fraser Institute as a proxy for economic freedom and the rate of moderately skilled and highly skilled emigration functions as a proxy for brain drain.
